Risk Retention Group​

A risk retention group (RRG) is required by the Liability Risk Retention Act of 1986 (LRRA) to register with each state in which it intends to do business. A list of documents required to be submitted to OCI is included in the Risk Retention Group Registration ChecklistDigital filing is the preferred filing method. All RRGs including the RRGs seeking approval to write health care liability coverage under ch. 655, Wis. Stat., must first register with OCI.

Participants in Wisconsin's Injured Patients and Families Compensation Fund are required to maintain health care liability coverage. This coverage can only be written by licensed insurers, qualified self-insurers or registered RRGs that have been specifically approved by OCI to provide health care liability coverage under ch. 655, Wis. Stat. A Risk Retention Group Health Care Liability Coverage Application for Approval must be completed by an RRG and approved by OCI in order for the RRG to write health care liability coverage that qualifies as proof of financial responsibility for the Wisconsin Injured Patients and Families Compensation Fund.

Approvals for RRGs to issue health care liability policies that qualify as proof of financial responsibility for participants in the Wisconsin Injured Patients and Families Compensation Fund expire each August 31. A Risk Retention Group Health Care Liability Coverage Renewal Application for Approval must be filed by July 1 and approved annually to remain approved to issue new qualified health care liability policies for the next September 1 to August 31 annual period. OCI does not issue reminders. It is the obligation of the RRG to annually file for approval to remain on the list of RRGs approved to issue health care liability policies that qualify as proof of financial responsibility for participants in the Wisconsin Injured Patients and Families Compensation Fund. Registration by an RRG to do business in Wisconsin does not permit an RRG to also issue health care liability policies that qualify as proof of financial responsibility for participants in the Wisconsin Injured Patients and Families Compensation Fund. Qualifying health care liability coverage can only be issued if the RRG receives approval annually from OCI.

OCI maintains a li​st​ of the RRGs that obtained approval to write health care liability coverage for participants that qualifies as proof of financial responsibility for the Wisconsin Injured Patients and Families Compensation Fund.
